Creditors’ interest intermediation

The main guarantee that in case of borrower’s bankruptcy creditor’s claims are satisfied is a proper legal intermediation at all stages including:

* creditors’ interest intermediation in courts of arbitration during insolvency (bankruptcy) proceedings;

* initiation of the bankruptcy procedure against the debtor;

* preparation of documents necessary for inclusion in the register of creditors’ claims. Working out a legal proposition for the assessment of a size of creditor claims;

* control over the performance of the insolvency administrator, and over the fulfillment by the debtor’s insolvency manager of his duties in compliance with the Federal Law “On Insolvency (Bankruptcy)” as well as legal assessment of the performance of the insolvency manager;

* the validity check of the data contained in the report by the insolvency manager, analysis of debtor’s financial situation, the conclusion about existence or absence of traces of premeditated (fraudulent) bankruptcy;

*analysis of debtor’s financial and economic activities and detecting traces of premeditated (fraudulent) bankruptcy;

* representation of creditors’ interests during creditors’ meetings (creditor committees’ meetings), preparation (legal due diligence) of creditors’ decisions concerning the agenda of creditors’ meetings. Preparation and legal support of the consideration of petitions seeking invalidation of decisions of creditors’ meeting (committee);

* selection of a candidate for the position of insolvency manager upon the institution of insolvency (bankruptcy) proceedings. Working out a legal proposition and participation in the processing of complaints against action/inaction of the insolvency manager and appeals to dismiss the insolvency manager;

* organization and conduct of the auction sale of debtor’s property;

* collection of accounts due to the customer;

* recognition of transactions as void;

* taking inventory of debtor’s property.
